Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://www.saltyslures.com website and the My Mobile App mobile application (the "Service") operated by Salty's ("us", "we", or "our").
By placing an order you agree to be bound by these Terms. If you disagree with any part of the Terms then please do not order.
If you wish to purchase any product or service made available through Salty's ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name and billing information. Salty's does not sell or use your information for any other purpose than to ship product to you or to contact you in the event of an issue with your order or something on it
Sales Policies and Miscellaneous Information
Payment: We accept Visa, Mastercard, American Express, Discover and Paypal. Checks can be accepted with a mail order however we may allow up to 7 days for this to clear our bank before any orders are shipped.
Shipping: 11/2022 We are currently shipping once per week. Orders will be filled on Saturdays and ship on the following Monday. Thank you for your understanding. We ship via USPS for the best package control and tracking. When your order is processed and the shipping information is transmitted electronically to USPS, you will receive an email from us with your package tracking information. If you have placed an order and haven't seen a email with this information then please check your spam folders before asking for tracking information as we find many times people have received the tracking email but miss it due to the large volume of spam messages prevalent on the internet. While we give priority to Air shipment orders, we cannot make a guarantee that your order will ship on an expedited basis. Click here for a time in transit once your package ships.
Overseas Shipping: Yes we do ship overseas. We only ship via US Priority Mail International. Covid has stopped shipping to many countries. Enter your order in on the site, it will calculate a rate, this rate may be more or less. If it's less you will get an adjustment. If it's more you will get an email with a request for the difference and the order will be held for 3 days for you to approve or deny the new charges. If you deny and have paid via Paypal your order will be cancelled and you will receive a credit on your paypal account. If you approve then the order is re-invoiced and processed for payment. The USPS priority calculator is here: http://ircalc.usps.gov/ this will give you a rough idea of what it costs. Please don't select lures off the website and email a list. We cannot pre-calculate the cost. It is done automatically online through the USPS website.
Important: There is no insurance on overseas shipments. It's extremely expensive and if a box is ever lost it's not worth the time to collect on the package because of the labor involved. In almost 20 years at the time of this writing I can remember only 2 boxes that have ever been lost. Once outside of our hands it is beyond our control what happens to your package. Australia, NZ, Abu Dhabi, Samoas, Hawaii, Germany, France, Kuwait, Tahiti, Fiji, all kinds of places we regularly ship to and have never had issues. There are some countries though where they steal any packages that fit a profile. We try to make something as non descript as possible but customs forms on the outside of the package are a dead giveaway and someone could then steal.
Third Party Shipping: Bank rules dictate that we must ship to the credit card billing address to prevent fraudulent transactions. The address you use on your order must match the street and zip code of your credit card billing address or the order cannot be processed. If you use a Post Office Box for your mailing address please indicate this in the comment field of your order. Orders that are received without a matching verifiable address will be refused as they are considered an automatic fraudulent transaction by the credit card companies.
Checks/Insufficient payment: Any checks received that are returned for non payment we will assess a $50 returned check fee. We don't make rubber lures so please don't send us rubber checks :)
Returns: Decide you don't like a size or color? For all un-opened merchandise in original condition we allow a 7 day no hassle return. Refunds are provided as a store credit. See included instructions on sheet in box for return.
*We cannot accept returns on any open or used product, wood squares, lead, plug bodies or liquids* due to hazmat regulations and re-packaging. It is the customers responsibility to insure, properly re-package, and return ship pieces for return.
Items that have been opened will not be accepted for return unless it is clearly evident that the package was damaged in shipping. No claims for damages after 7 days from receipt of package. Salty's will accept returns for replacement of any lures/parts found defective from manufacturing within the first 90 days of purchase. Product is exchanged/repaired at our discretion. Returns must be accompanied by a copy of your sales receipt for date verification.
IMPORTANT: This return policy supersedes any return policy offered by your form of payment. Returns for problems are VERY few and far between but given the volume our shop puts out it's possible to occasionally have a problem with a lure/part-we're human and can miss something (although we try REAL hard not to).
If a lure/part is deemed defective and cannot be repaired we will ship you a replacement at no extra charge to you. Returns for any other reason are not accepted.
Occasionally we may ship a lure of the wrong color or type, if this should happen please accept our sincere apologies, we do sometimes make mistakes and we're happy to make it right, please contact us asap.
Damage from fishing, ie rocks, bluefish, etc is considered normal wear and tear and not a defect. As our lures are hand-made there can be minor imperfections, grain, etc that does not affect their use-ability and adds to the character of the lure. We very closely inspect every lure and any that don't meet our quality control are marked as a blem or marked up as a mackerel back lure to distinguish it from first class product.
Any kits that don't meet our quality control standards are discarded.
Online pictorials are guides for kit assembly only. We reserve the right to make changes to any of our lures without notice.
Sportfishing Excise Tax: All items under 150lb test are subject to the Federal sportfishing excise tax. Items which are exempt such as wood squares and other misc items on the site are not subject to the excise tax. If you are excise tax exempt (form 637) we need a copy of this form filled out and emailed or faxed to us with your order: Excise Exemption Certificate Some people don't understand what the excise tax is...it is administered by the IRS for the purpose of raising money for your local state fish & wildlife programs. It funds access, stocking programs, enforcement, kids programs etc. Unfortunately there's many who skirt the tax operating out of their basements and garages and it hurts all fishermen. As a legal US manufacturer of fishing tackle we are required to collect and pay this tax on every item we sell that can embellish, increase the effectiveness of, improve the durability or appearance of any lure whether it has hooks or not, or is normally a product used in fishing. We break the tax out from each item to show it as a separate line item. Excise tax is paid on the constructive sales price of each item. California Proposition 65 labeling: All products that have been determined to be on the California proposition 65 list for chemicals are shown as such on the website and packaging. We are required by law to post this on the website as well as all packaging entering the state of California. As such all products containing known carcinogens will be labeled with appropriate Prop 65 labeling in existence as of this page edit. As a two person company, Saltys is exempt from having to list anything for Prop 65. We are voluntarily listing this to notify the customer of the health hazard. Where necessary products will be noted with a WARNING such as this:
WARNING: This product can expose you to chemicals including XXXXX, which is known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov.
Saltys is a small business and exempt from California Proposition 65 warning requirements, but choose to provide them voluntarily for known chemicals per California law. Wash hands after handling, DO NOT smoke or eat with contaminated hands! Keep away from children and do not ingest! USE COMMON SENSE!
Use of information collected: Salty's does not disclose to anyone or any company any information it collects to process orders. Your information including telephone numbers, email addresses, etc will not ever be sold or given out to any other company. We respect your privacy. All credit card information is stored securely and destroyed after use in accordance with standard Visa/MC/Amex/Discover/Paypal policies.
Care of your lures: We highly recommend that you rinse your lures with fresh water after each use in saltwater to prevent corrosion of the hooks and swivels etc. Some colors used in lures are actually aniline dyes and can fade slightly in the sun-try to store your lures in a area away from the sun (not on your dashboard etc) Allow your lures to dry thoroughly before storing to prevent additional corrosion or mildew damage in damp areas. Do not store your lures near pool chemicals or any chemical containing chlorine as it will cause them to prematurely rust/corrode.
